DMCA Notice

iNeon Gift respects the rights of creators and expects shoppers to do the same. If you believe something on ineongift.com — a product image, a design, a product description or text a customer requested — infringes a copyright you own or are authorized to act for, you can send us a notice under the Digital Millennium Copyright Act (DMCA).

Sending a takedown notice

Email help@ineongift.com with “DMCA Notice” in the subject line and include:

  1. Your full name and contact details (email, and postal address or phone number).
  2. A description of the copyrighted work you say is being infringed.
  3. The URL of each page on ineongift.com where the material appears.
  4. A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law.
  5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
  6. Your physical or electronic signature.

Notices missing these details may be returned so you can complete them.

What happens next

We review each complete notice and, where it is valid, remove or disable access to the material. We may let the person who supplied the material know about the removal and pass on a copy of the notice.

Counter-notice

If material you supplied was taken down and you believe it was a mistake or misidentification, email us a counter-notice containing:

  • your name, contact details and signature;
  • a description of the removed material and the URL where it appeared;
  • a statement under penalty of perjury that you believe in good faith the material was removed by mistake or misidentification;
  • your consent to the jurisdiction of the appropriate court for your address.

Where the law allows, we may restore the material unless the original complainant tells us they have started legal action.

Repeat infringement

We may refuse orders or close accounts of people who repeatedly submit infringing material.

Making a knowingly false claim in a notice or counter-notice can result in legal liability. See also our Copyright page.
